Book Review: “The Woomera Manual on the International Law of Military Space Operations”

Today, an important book has been released by Oxford University Press. The book, titled “The Woomera Manual on the International Law of Military Space Operations,” is authored by a group of experts under the supervision of Professor Jack Beard from the University of Nebraska-Lincoln College of Law and Professor Dale Stephens from the University of Adelaide’s Research Unit on Military Law and Ethics.

The Woomera Manual is the result of a multi-year project prepared by a group of expert participants from around the world who combined their expertise in law and technology related to military space activities and operations. Their aim was to identify and clarify the existing international law rules applicable to military space activities and operations, explain the basis for these rules, and identify areas of legal uncertainty that still remain. The manual is intended to assist those who are required to apply international law in contexts of strategic decision-making, policy formulation, and military activities and operations in space.

The book is divided into three sections that explain and analyze 48 rules of international law governing space in times of peace, crisis, and war. More broadly, it is designed to assist military and civilian government personnel, space operators, practitioners, members of international organizations, and NGOs involved in military space activities and operations, as well as other interested observers. It is hoped that the manual will become a useful and reliable reference tool to help governments and military forces avoid miscalculations or strategic mistakes, promote peaceful cooperation in space, and provide a safer and more predictable framework for military space activities and operations in times of peace, tension, and armed conflict if necessary.

These contributions have significantly shaped all the rules and commentaries of the manual, helping to make it a unique reference for vital information. The Woomera Manual is considered a useful and compelling source for military and civilian government personnel, space operators, practitioners, academics, members of international organizations, and NGOs involved in military space activities and operations. With its primary focus on state practices and the rule of law, the Woomera Manual is the first comprehensive examination of international law as it applies to the full spectrum of military space conduct: operations and activities in times of peace, high tension, and armed conflict.

This guide is a timely and important study, as human activities in space are increasing at an unprecedented rate, with more countries and companies, as well as other non-governmental entities, accessing space for a vast and growing array of purposes. There is every reason to expect this increase in diverse use of space to continue. At the same time, the risks of an arms race and even armed conflict in space are also rising, necessitating focused attention on current and potential military activities and operations.

Therefore, the international legal framework for space is under unprecedented pressure. Treaties, customary international law, and related space rules are vital for the peaceful exploration and use of space, but they have not received enough study and attention. With the new opportunities and challenges facing the international community in this field, the need for rule-based cooperation for space exploration and use is greater than ever.

Importantly, the sole focus of the Woomera Manual is to summarize and organize the existing law (“the law as it is”), without any prescriptive agenda. No one believes that the current set of space laws will be sufficient to regulate all future activities. The current principles and rules are the vital core, but they will require supplementation as human activities in space continue – but it is not the task of this manual to speculate or recommend. Where the current law is unclear, and where agreed official interpretations have not yet emerged, the manual acknowledges this uncertainty.

A fundamental aspect of the manual’s methodology is its primary focus on state practices. The manual focuses on the actions and statements of states, and their reactions to the actions and statements of others, to identify and study the existing rules of international law and their ongoing development. This careful attention to state practices distinguishes this manual from some other works, as it does not rely on expert opinions or interpretations. The manual provides numerous citations, enabling subsequent researchers to identify and scrutinize the state practices underpinning the detailed rules in addressing such an evolving subject.

The Woomera Manual anticipates the emergence of relevant technologies several years into the future, expecting the application of today’s rules to tomorrow’s circumstances. However, it is constrained to relatively near-term developments and does not speculate on distant prospects.

The Woomera Manual on the International Law of Military Space Operations is interdisciplinary in its analyses, drawing on space law, national security law, technology, international law, and diplomacy. Thus, the Woomera Manual serves as the first comprehensive examination of this field, analyzing the three stages of military space interactions (during peacetime, tension or crises, and armed conflict) with relevance to both the public and private space sectors. Through careful research and a particular focus on state practices, it explores the interaction between different legal systems, including space law, the UN Charter, other treaty-based systems, and international humanitarian law.
