الملخص
استطاع المشرع الجزائري أن يواكب دول العالم المتقدمة من خلال المصادقة على الاتفاقيات الدولية بخصوص جرائم المساس بأنظمة المعالجة الآلية للمعلومات، وذلك بنصه على وضع إطار قانوني لمكافحتها، بهدف التضييق على المجرمين من جهة ، والحد من التوسع الإجرامي الخطير من جهة أخرى، رغم اتجاه بعض الفقهاء للقول أن فيها مساس بالحرية الشخصية . وعلى العموم استطاع المشرع من خلال تعديله لقانون العقوبات بموجب القانون رقم 04-15 أن يبين الأفعال المكونة لهذه الجريمة، وينص على العقوبات المترتبة في حال ارتكباها، إلا أن هذا الجهد التشريعي يبقى مفعوله نسبي، وللتخلي عن النسبية المذكورة ضروري التشديد في تطبيق القانون في الميدان. الكلمات المفتاحية: المعالجة، المعلومات، جرائم، قانون، الآلية.
Abstract:The Algerian legislator was able to keep pace with the developed world by ratifying international agreements regarding crimes against prejudice to the systems of automatic processing of information, by providing for a legal framework to combat it, with the aim of restricting criminals on the one hand, and limiting dangerous criminal expansion on the other hand, despite the direction of some jurists To say that it harms personal freedom. On the whole, the legislator was able, through its amendment of the Penal Code under Law No. 04-15 to clarify the actions that make up this crime, and stipulate the penalties incurred in the event of its commission, but this legislative effort remains a relative effect, and to give up the said relativity is necessary to tighten the application of the law in the field .
